A man who police said was shot by Eaton officers in an exchange of gunfire has been identified and arrested.

Levi Miller, 30, was booked into the Weld County Jail on Friday morning on suspicion of first-degree assault, attempted manslaughter and attempted first-degree murder of a peace officer, according to a news release.

At about 1:30 a.m. on Sept. 24, officers responded to the 1200 block of Aspen Court on a report of a disturbance, an argument between and man and a woman, according to the Weld County Sheriff’s Office.

Two officers arrived and encountered Miller, who was armed. Miller allegedly fired multiple shots at officers who returned fire, the news release said, hitting him. He was taken to a local hospital.

The Weld County Critical Incident Response Team is investigating the police shooting. A bond hearing for Miller was scheduled on Friday afternoon.
